EU opens investigation into Google’s use of online content for AI models

The EU has opened an investigation to assess whether Google is breaching European competition rules in its use of online content from publishers and YouTube creators for artificial intelligence,The European Commission said on Tuesday it would examine whether the US tech company, which runs the Gemini AI model and is owned by Alphabet, was putting rival AI owners at a “disadvantage”,The commission said: “The investigation will notably examine whether Google is distorting competition by imposing unfair terms and conditions on publishers and content creators, or by granting itself privileged access to such content, thereby placing developers of rival AI models at a disadvantage,”It said it was concerned that Google may have used content from web publishers to generate AI-powered services on its search results pages without appropriate compensation to publishers and without offering them the possibility to refuse such use of their content,The commission said it was also concerned as to whether Google had used content uploaded to YouTube to train its own generative AI models without offering creators compensation or the possibility to refuse.

“Content creators uploading videos on YouTube have an obligation to grant Google permission to use their data for different purposes, including for training generative AI models,” the commission said.Google bars third-party companies from using YouTube videos for AI model training, unless creators or rights holders turn on a setting that allows companies to use their content for the training. However, YouTube also tells creators that it uses videos uploaded to the platform to “improve the product experience for creators and viewers across YouTube and Google, including through machine learning and AI applications”.CNBC reported in June that Google was using YouTube videos to train its Gemini and Veo3 models.Google said it used a subset of videos for training purposes.

In September, YouTube said: “We use content uploaded to YouTube to improve the product experience for creators and viewers across YouTube and Google, including through machine learning and AI applications.”The EU’s competition chief, Teresa Ribera, said: “AI is bringing remarkable innovation and many benefits for people and businesses across Europe, but this progress cannot come at the expense of the principles at the heart of our societies.”A spokesperson for Google said: “This complaint risks stifling innovation in a market that is more competitive than ever.Europeans deserve to benefit from the latest technologies and we will continue to work closely with the news and creative industries as they transition to the AI era.”The EU’s investigation is the latest in a series of challenges to US big tech companies in recent years.

In September, EU regulators issued a fine of almost €3bn (£2,6bn) against Google, claiming that it favoured its own digital advertising services over rivals,Donald Trump said the fine was “discriminatory”,Sign up to Business TodayGet set for the working day – we'll point you to all the business news and analysis you need every morningafter newsletter promotionElon Musk’s social media company X, formerly known as Twitter, was fined €120m by EU tech regulators last week for breaching online content rules,The breaches included what the EU said was a “deceptive” blue tick verification badge given to users and the lack of transparency of the platform’s advertising.

The fine also attracted criticism from US officials, including the secretary of state, Marco Rubio, who wrote on X that the fine was “an attack on all American tech platforms and the American people by foreign governments”,The European Commission opened an investigation earlier this year into Meta over its introduction of AI features on WhatsApp, its messaging platform,Last year it fined Meta €798m for abusive practices benefiting Facebook Marketplace,In 2024, Apple lost a fight against an order by EU competition regulators to pay €13bn in back taxes to Ireland,Last month the head of Google’s parent company said people should not “blindly trust” everything AI tools told them.

Sundar Pichai, the chief executive of Alphabet, said AI models were “prone to errors” and urged people to use them alongside other tools,He also predicted that no company would be immune if the AI bubble burst,Reuters contributed to this report

England’s Ashes approach is scrambling the brains of the next cricketing generation | Mark Ramprakash

The cracks are starting to show with this England team and with the narrative we’ve been fed for three years after another defeat. Their identity of always taking the aggressive option, of relentlessly putting pressure on their opponents, isn’t holding up to scrutiny. So far in this series they haven’t had the strength needed to achieve it, and they haven’t had the skills either.I was confident that they could win the Ashes this time, mainly because I thought there was quality in the squad and that they had adapted their game to add intelligence and adaptability to their armoury. It’s becoming clear that neither of those beliefs were completely true

Claressa Shields to open $8m deal with Detroit rematch against Crews-Dezurn

Claressa Shields will defend her undisputed heavyweight championship in Detroit on 22 February, returning home for a rematch with Franchon Crews-Dezurn in her first fight since signing a landmark $8m promotional deal. The bout will headline a Dazn card at Little Caesars Arena, the home of the NBA’s Pistons and NHL’s Red Wings where Shields attracted a near-sellout crowd for her most recent fight last July.Shields (17-0, 3 KO) and Crews-Dezurn (10-2, 2 KO) first met nearly a decade ago when they made their professional debuts against each other on the undercard of Andre Ward’s victory over Sergey Kovalev in 2016. Shields won a four-round unanimous decision that night in Las Vegas, a moment she still sees as formative. “I had just come off winning two Olympic gold medals, fresh out of the amateurs, and finding an opponent was tough,” she said in a press release announcing the fight

Peter Nichols obituary

My friend and former sports-writing colleague at the Observer Peter Nichols, who has died from Parkinson’s-related dementia aged 79, was a man of many talents: drama teacher, Time Out cabaret correspondent, athletics correspondent, London Marathon international race organiser, publisher and award-winning radio scriptwriter.Pete was a sporting Google long before Google was invented. He was a sharer, the go-to source at the seven Olympiads he covered. “Pete was utterly invaluable,” recalls the former Guardian head of sport Ben Clissitt. “His input was the Guardian playbook for our Olympic coverage

Alex de Minaur on his grand slam dream: ‘Some things may happen, some things may not’

The Australian is pragmatic about his chances of winning a major in the Alcaraz-Sinner era but knows he plays his best tennis when he doesn’t put pressure on himselfIt’s hard to think of anyone in tennis who works harder than Alex de Minaur, the Australian who next month will again carry the hopes of a nation as he tries to become the first home winner of the men’s title at the Australian Open for 50 years. No one is faster around the court, no one more diligent off it than the 26-year-old. It’s a work ethic that has helped him to 10 titles so far in his career and he ends 2025 as the world No 7, his highest year-end ranking, and having won the prestigious Newcombe medal for a fourth time. But in a sport where success at the very top level is ultimately judged by performances at grand slams, De Minaur has so far fallen short. He has made the quarter-finals of a major six times – including five of the past eight – but with Carlos Alcaraz and Jannik Sinner having split the last eight majors, opportunities are scarce

Michael van Gerwen: ‘Of course I love darts, but I love my kids much more’

The former world No 1 shares how a traumatic year has shaped him as a darts player and a father and insists he can recapture his glory days at the world championship“I can be a miserable bastard sometimes,” Michael van Gerwen says with a grin and a shrug as he tries to explain his new burst of optimism after a horribly testing year. “But I can also be quite positive. If you asked me this question a month ago, and we did this interview then, you would find me a bit different to today. But I feel good now even if, 100%, this has been a very tough year for me both on and off the oche.”Rather than being miserable, the 36-year-old is amiable company – which seems remarkable as in 2025 he has been through a divorce after 17 years with his wife, Daphne, witnessed the devastating effect of cancer on his father, endured intense scrutiny in the Dutch media, and struggled to regain his once imperious form with the arrows
